As used in this contract «ticket» means this passenger ticket and baggage check, or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions and notices form part, «carriage» is equivalent to «transportation», «Carrier» means all air Carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, «electronic ticket» means the Itinerary/Receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document. «WARSAW CONVENTION» means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at The Hague, 28th September 1955, whichever may be applicable.
The Carrier has a right to cancel/ to delay the flight, indicated in the ticket or airway bill, to change the aircraft type, to change the itinerary, if flight and/or aviation safety conditions require it, just as in case when a public agency demand it in accordance with their competence.
In case of substituting the aircraft type, the Carrier informs the passenger on such replacement by placing the given information on the site of OJSC Vladivostok Air, and also during the check-in.
During ticket issuance the passenger should comply with all REQUIREMENTS of the passport and visa control, Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by the Carrier or, if no time is fixed, early enough to complete departure procedures.
In case if the passenger independently defines route and flight connections of the Carrier and other airlines and transportation is issued by the separate air tickets, the Carrier is not liable for maintenance of the given connection.
No agent, servant or representative of the Carrier has authority to alter, modify or waive any provision of this contract.
If the passenger’s journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention may be applicable and the Convention governs and in most cases limits the liability of the Carriers for death or personal injury and in respect of loss of or damage to baggage.
Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention unless such carriage is not «international carriage» as defined by that Convention.
Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion (stage) entirely within the country of origin or destination.
For such passengers on a journey to, from or with an agreed stopping place in the United States of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the liability of certain Carriers, parties to such special contracts, for death of or personal injury to passengers is limited in most cases to proven damages not to exceed U.S. $ 75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of the Carrier. For such passengers traveling by a Carrier not a party to such special contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the Carrier for death or personal injury to passengers is limited in most cases to approximately U.S. $ 10,000 or U.S. $ 20,000 or their equivalent in the foreign national currency at the official exchange rate.
The names of Carriers, parties to such special contracts, are available at all ticket offices of such Carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the Carrier’s liability under the Warsaw Convention or such special contracts of carriage. For further information please consult your airline or insurance company representative.
Note: The limit of liability of U.S. $ 75,000 above is inclusive of legal fees and costs except that in case of a claim brought in a state where provision is made for separate award of legal fees and costs, the limit shall be the sum of U.S. $ 58,000 exclusive of legal fees and costs.
The liability of aircraft operator for death or personal injury to the passenger of the aircraft on any domestic flight is limited to the sum provided by the Russian Federation Civil Laws.
To the extent not in conflict with the foregoing carriage and other services performed by each Carrier are subject to: (I) provisions contained in the ticket, (II) applicable tariffs, (III) Carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of Carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.
An air Carrier issuing a ticket for carriage over the lines of another air Carrier does so only as its Agent.
Any exclusion or limitation of liability of the Carrier shall apply to and be for the benefit of agents, servants and representatives of the Carrier and any person whose aircraft is used by the Carrier for carriage and its agents, servants and representatives.
In those countries where Denied Boarding Compensation regulations are in force, Carriers operate compensation plans for passengers with confirmed reservations who are denied boarding because of non-availability of seats caused by overbooking.
The Carrier is liable in the following amounts for the loss, shortage or damage (or deterioration) of baggage, cargo and carry-on items:
Passenger ticket and baggage check is a document certifying the contract for the passenger and baggage carriage concluded between the passenger and the Carrier. This passenger ticket is valid for the air transportation on the territory of Russia and international carriage. In case the airport authorities establish additional taxes it should be paid on the spot.
Check-in deadlines have to be observed at the 40 minutes before departure. If you have not reported for check-in by the fixed time, the Carrier may dispose otherwise of your seat. Departure time indicated in the ticket is local.

Changes of carriage and refund conditions for not used sums which are an integral part of the present contract are made in accordance with the Fare Rules on which the air ticket is issued.
This ticket is good for carriage only for the indicated flight and date and for the person for whom the ticket was issued.
At purchase of the air ticket or change of conditions of transportation the passenger should familiarize with the contract, check up the ticket (name, flight, route, class of service, date/time of departure). If the passenger has not designated the remark, claims at reception of the air ticket it means the consent with conditions of the present contract.
In the case of forced withdrawal from the flight or some part of transportation, passenger is paid the entire sum for transportation, except for the case when transportation of the passenger has been partially performed, and he or she has accepted the executed part of transportation. In case the passenger has accepted the carried out part of transportation he/she is refunded for the not performed part of transportation.
If the passenger declared that the ticket has been lost, either incorrectly issued, or damaged, the Carrier uses his best efforts for establishment the fact of conclusion of the passenger carriage agreement. If it will be established, that the air carriage agreement was not concluded, the ticket is nullified, and the passenger is disallowed for carriage.
If it will be established, that the air carriage agreement was really concluded, the Carrier accepts the passenger for transportation according to conditions of the concluded passenger carriage agreement with corresponding air ticket registration.
Passengers may take some small articles in cabin (handbags, etc.) which can be carried in the cabin within the limit of free baggage allowance without any Carries liability for these articles. Maximum weight of one article shouldn't be more than 5 kg with maximum size of 45×35×15 cm. Only one article is allowed on board cabin baggage.
Free baggage allowance, including handbags, is established by the Carrier depending on the applied tariff, but cannot be less than 10 kg per passenger.
Pets and birds can be transported by prior consent of the Carrier and in virtue of written permission obtained by passenger himself from the departments of veterinary and customs control.
The baggage, which dimensions of a parcel in packed state exceed 203 cm in the sum of three measurements (excess baggage) is accepted for transportation under the preliminary coordination with the Carrier.
The baggage which weight of a parcel exceeds 32 kg (heavy baggage) is accepted for transportation under the preliminary coordination with the Carrier.
Passengers must pay extra chargers for baggage in excess of free baggage allowance indicated on the appropriate coupon of the flight ticket, according to the rate applicable on the day of issue of the excess baggage ticket.
The Carrier has the right to limit the weight of the excess baggage over the free baggage allowance.
The Carrier accepts only baggage in package which excludes access to content and ensures safety of carrying articles.
If a passenger intends to bring baggage in excess of the prearranged and paid weight, that baggage will be accepted only if the maximum payload capacity of the aircraft is not exceeded, and after payment of the excess baggage charges.
The Carrier assumes no liability for fragile, valuable or perishable articles. Passengers must carry cash and documents with themselves.
The Carrier is responsible for the registered baggage from the time it is handed over by a passenger for transportation to the time it is returned to him/her.
Checked baggage will be delivered to bearer of the baggage check, according to the quantity of places, and weight specified in the air ticket. In case of damage to baggage complaint must be made in writing to the Carrier forthwith after discovery of damage and, at the latest, within 7 days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered.
Claims concerning baggage which has been taken out from a baggage claim are not accepted.
Arms, ammunition and special facilities of passengers authorized to posses and carry such facilities are subject to withdrawal for the whole flight time under statement by an officer in charge of security inspection. They are to be returned at the airport of destination.
Objects which could be used to attack the crew or passengers (knives, axes, snow axes, pneumatic arms, hunting guns, imitation of arms and other thrust and cutting objects) must be packed in a baggage.
Arms, ammunition and special facilities enter into norm of transportation of free-of-charge baggage.
Liability for loss, delay, or damage to baggage is limited unless a higher baggage value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys) the liability limit is approximately U.S. $ 9.07 per pound (U.S. $ 20.00 per kilo) for checked baggage and U.S.$ 400.00 per passenger for unchecked baggage in point of each passenger.
For travel wholly between U.S. points, Federal rules require any limit on an airline's baggage liability to be at least US $2,800 per passenger.
Excess valuation may be declared on certain types of articles. Some Carriers assume no liability for fragile, valuable or perishable articles.
